Scholarly Consensus
Accordingly, Muslim scholars have reached a consensus on the permissibility of performing Hajj and Umrah on behalf of the disabled, the sick, and the deceased, provided that the performer has already performed the obligatory pilgrimage for themselves. It is also permissible to perform Umrah for the deceased, whether they willed it or not.
The Hanbalis hold that Umrah is not permissible on behalf of a living person except with their permission, as it is a form of worship that allows representation. As for the deceased, it is permissible without their permission.
Representation is permissible in performing Umrah on behalf of others if they are deceased or unable to perform it themselves. Whoever dies with an obligatory Umrah pending, it must be performed out of their estate. If a stranger performs it on their behalf, it is valid even without permission, analogous to paying a debt. Voluntary representation is permissible if the person is unable themselves, similar to representing the deceased.
The Malikis hold that delegation for Umrah is disliked (Makruh), but if it takes place, it is valid.
The Hanafis hold that it is permissible to perform Umrah on behalf of another with their permission, as its permissibility is through representation, and representation is only established by command. If commanded, and the person enters Ihram and performs it, it is valid.
